Ex-officer not liable in motorcycle accident

A federal jury sitting in U.S. District Court in Bangor found a former Augusta police officer not liable for violating a Manchester man’s civil rights and not liable for the motorcycle accident that seriously injured him.

The jury of three women and three men deliberated about one hour before returning the decision that Randy Evans, 29, was not responsible for the August 1987 accident that injured Dean Beaulieu, 30.

Beaulieu had brought a civil lawsuit against the former police officer and the city of Augusta, charging that his constitutional rights had been violated when Evans allegedly implemented a “rolling roadblock” to stop him while he was riding his motorcycle.

Evans maintained that he didn’t use the roadblock technique, and, in fact, was nowhere near the motorcycle when it crashed on an Augusta street.

Testimony was completed Wednesday in the one-day civil trial, and the jury was instructed and completed its deliberations Thursday.

“The jury got it right,” said defense attorney Theodore Kirchner of Portland, who represented Evans. Kirchner said his client no longer worked with the Augusta Police Department. The attorney said Evans had filed a grievance against the department on a matter that had nothing to do with the case heard in Bangor.

“We’re extremely disappointed,” said the plaintiff’s attorney, William Robitzek of Lewiston. “The jury obviously heard the evidence and made a decision.”
