HOLDEN — The town of Holden will receive $9,300 in fines and attorney’s fees from a man who admitted to discarding oil tanks there.
The details were revealed in consent agreement signed Friday at 3rd District Court, Bangor, by town officials and Stephen Fleming, who operates Fleming Construction Co. in neighboring Dedham.
The town brought suit against Fleming last month in connection with the dumping.
According to the terms of Friday’s consent agreement, Fleming:
Admits to violating the zoning ordinance pertaining to junkyards, having failed to obtain a permit to discard the tanks.
Agrees to pay a $7,500 fine and $1,800 in the town’s attorney’s fees in monthly installments of $5,000 in September; $2,500 in October; and $1,800 in November.
Agrees to pay further attorney’s fees if the town must enforce the agreement.
Holden Code Enforcement Officer Stephen Condon and Town Manager R. Larry Varisco signed the agreement on behalf of the town, which was represented in court by Wayne Foote. Fleming’s attorney, Curtis E. Kimball, signed it on his client’s behalf.
