PORTLAND — The state supreme court Tuesday upheld the conviction of a Nobleboro man who was found guilty in a non-jury trial of raping a woman and stealing her car.

The Maine Supreme Judicial Court unanimously upheld the ruling against James Oliver.

Oliver was convicted of raping the 27-year-old woman on the town landing in Bremen on June 20, 1978, then stealing her car. The car was found four months later on a road about a mile from the home of Oliver’s mother.

The defendant appealed the conviction, contending he did not validly waive his right to a jury trial and that the judge should not have allowed as evidence statements the victim made to her doctor.

The supreme court ruled against Oliver on both counts.
