Bar Harbor board delays theater appeal

BAR HARBOR – The zoning appeals board reconsideration of the Criterion Theater’s right to become involved in its competitor’s permit approval has been delayed until 7 p.m. Wednesday, Jan. 24.

Only three members of the board were available Tuesday to decide whether Betty Jean Morison, owner of the Criterion, has standing to bring appeals against the building permit that Bar Harbor’s planning board granted to Reel Pizza Cinerama.

Reel Pizza plans to demolish its current building and construct a 220-seat theater-restaurant combination.

The board’s original vote in December tied 2-2 on whether Morison’s complaints should be heard, constituting a technical rejection of her request.

Three members would constitute a quorum of the board – which numbers only four in this case because members Ellen Dohmen and Donald Hobbs recused themselves for personal conflicts.

However, members present Tuesday decided to hold their decision until all four voting members are available, due to the board’s limited size.
