Suit targets bus driver in first-grader’s injury

NORTH BERWICK – The family of a first-grader whose face was pushed through a school bus window is suing.

The family’s lawsuit in York County Superior Court targets School Administrative District 60, blaming the boy’s injury on the bus driver’s failure to control a youngster described as a “known troublemaker.” The victim, who was a student at North Berwick Primary School, needed stitches to close wounds on his face, and he will bear some of the scars for the rest of his life, said Peter Thompson, the family’s lawyer.

According to court documents, “SAD 60 failed to exercise due care in the training, supervision and retention of the bus driver.”

In its response, lawyers for the school district said the fault lies more with the aggressor who caused the injury. Thompson declined to identify any details about the alleged attacker, including the boy’s age or grade. The lawsuit seeks unspecified damages.
