Competency questions postpone arraignment

SKOWHEGAN – Accused murderer Derek-Finn Wilhelmsen, who is undergoing testing and treatment at Bangor Mental Health Institute, was not arraigned in Somerset County Superior Court on Friday as originally scheduled. The arraignment has been continued by Justice Nancy Mills “for a couple of weeks to ascertain the competency of the defendant,” according to court documents.

Earlier this week, a motion was filed jointly by Wilhelmsen’s attorney, Michaela Murphy of Skowhegan, and Assistant Attorney General Lisa Marchese, who is prosecuting the case.

The motion stated that “the defense has some concerns about the defendant’s competency.”

In addition, a state’s motion that would have compelled Wilhelmsen to undergo psychological testing has been withdrawn, said Murphy, because the defense has agreed to the mental examinations.

The motion to continue the arraignment stated, “The parties believe that the arraignment should be postponed until evaluations can be conducted of the defendant.”

Wilhelmsen is accused of shooting a Portland cabdriver to death in a Pittsfield driveway on Feb. 17. Court documents filed after his arrest indicate that Wilhelmsen had hired Nunzi Mancini to drive him to Pittsfield from Portland and that Wilhelmsen originally had planned to kill a former girlfriend and her baby.

Instead, Wilhelmsen allegedly became angry at Mancini when the cabdriver called the woman a vulgar name. Wilhelmsen is accused of and has confessed to shooting Mancini several times in the neck and shoulders as he sat behind the steering wheel of the cab.

Wilhelmsen then walked to the former girlfriend’s home and requested a ride to Bangor. The woman complied and, with another friend and the baby, drove Wilhelmsen to Bangor. The next morning, Wilhelmsen took a bus back to Portland where he was arrested later in the day after seeking mental health assistance.

Marchese did not return phone calls seeking information on Wilhelmsen’s status.
