2 smuggling cases among indictments

BANGOR – A federal grand jury handed up three indictments this week, including one against a Canadian man charged with smuggling OxyContin into the United States from Canada while his three young children accompanied him.

Wayne Dow, 37, of Tower Hill, New Brunswick, is free on bail but faces if convicted a maximum sentence of 20 years in prison and a $1 million fine for a charge of importation of OxyContin.

He was arrested in October a few miles north of Calais at the Milltown border crossing where, after he was questioned, he admitted to police that he was smuggling drugs.

Dow told agents with Immigration and Customs Enforcement that pills were hidden inside the arm of the vehicle’s center console, according to court documents.

Agents seized more than 6 grams of the narcotic from Dow’s vehicle. He told police that he was being paid $200 to transport the drugs across the U.S. border.

Dow’s defense attorney, Terence Harrigan of Bangor, said Wednesday that he would “be very surprised if Dow pled guilty” at his arraignment, which is scheduled for Wednesday in U.S. District Court.

Another man was indicted on charges of smuggling more than $100,000 into the country and possession of marijuana with intent to distribute.

If convicted, Nhu Phong Nguyen, 25, of Tewksbury, Mass., faces five years in prison for each charge, a maximum of $500,000 in fines and most likely will have to forfeit the money that was seized. He is being held at Penobscot County Jail

Nguyen was arrested Nov. 17 in Fort Kent after local police found him sitting in a van in a driveway of an empty house.

The van was registered to Arbella Mutual Insurance of Quincy, Mass., and Nguyen told authorities several different stories about why he was in Maine.

A search of the van by U.S. Border Patrol agents yielded approximately $120,000 in U.S. currency and at least 20 kilograms of marijuana.

Assistant U.S. Attorney Daniel J. Perry said Wednesday that the drug charge was added this week, making the case against Nguyen a little more intriguing. Perry didn’t say whether the large amount of cash and the marijuana were connected in some way.

Nguyen’s arraignment also is scheduled for Wednesday in U.S. District Court.

Elizabeth Robinson, 29, of Bangor faces a maximum of 20 years in prison and a $1 million fine for possession with intent to distribute and distribution of OxyContin if convicted.

Robinson was indicted this week and is being held at Penobscot County Jail on unrelated state charges.

Her case is reportedly connected to the case of a Bucksport man who was arrested in June in Brewer on drug charges.

Gregory Panther, 42, has since pleaded not guilty to federal charges of possession with intent to distribute OxyContin.

Correction: A story published in the Thursday, Dec. 9, State section about a Massachusetts man indicted for smuggling cash into the United States requires clarification. The van that Nhu Phong Nguyen, 25, was driving is not registered to Arbella Mutual Insurance of Quincy, Mass. That company insures the vehicle.
