DOVER-FOXCROFT – An Abbot man acquitted of gross sexual assault who admitted on the witness stand during that case in December that he had oral sex with a minor has been charged with another offense based on his testimony.
Dennis Boutilier, 24, will appear on the Class D misdemeanor charge of sexual abuse of a minor on March 6 in 13th District Court in Dover-Foxcroft.
“I have concerns about Mr. Boutilier; he’s not someone we should let go unchecked,” Piscataquis County District Attorney R. Christopher Almy said Tuesday.
Almy had attempted to convince a jury in December that Boutilier was guilty of gross sexual assault involving a 16-year-old girl, but the defendant was acquitted.
That jury trial came after Boutilier had pleaded no contest earlier in 2005 to the charge, but he later withdrew his plea when his victim’s family argued for more than the plea-bargained 364 days in prison. The case then went before a jury, which found him not guilty of the charge.
During the trial, the victim testified that when she was 14 years old she had oral sex with Boutilier, a fact Boutilier also admitted during cross-examination, according to Almy.
Although Almy had an audio-taped confession from Boutilier and was unable to convince a jury of Boutilier’s guilt in December, the prosecutor said he was sure he could prove the lesser charge since Boutilier admitted it while under oath.
