Sex charges dropped in Portland case

PORTLAND – Sexual assault charges have been dismissed against two New Hampshire men and a Florida teenager after problems arose with the alleged victim’s accusations, said Cumberland County District Attorney Stephanie Anderson.

The charges against Michael Coleman and Jonathan Santos, both 21 and from Manchester, N.H., and Jose Alcea, 17, of Fort Myers, Fla., were dismissed Friday, Anderson said.

Prosecutors found problems as they investigated the accusations made by a 19-year-old South Portland woman, who said she was assaulted last Aug. 10 while walking on St. John Street in Portland, Anderson said.

“Further investigation indicated to us that we had reasonable doubt about their guilt,” Anderson said. “So we were compelled to dismiss the charges.”

Coleman’s lawyer, J.P. DeGrinney, said prosecutors “did the right thing and dropped it.”

“[Coleman] wants everybody to know that he didn’t do this and he wants his good name back, if that’s possible,” he said.

A Cumberland County grand jury indicted Coleman and Santos in September and charged each with gross sexual assault and unlawful sexual contact. If convicted, they would have faced up to 30 years in prison.

Alcea was charged as a juvenile and would have faced detention until his 21st birthday.

Anderson would not specify the problems that arose with the case, but she said it was not a case of mistaken identity.
