Garland man to serve 18 months on drug, child pornography charges

BANGOR – A third appearance before a Superior Court judge Friday apparently was a charm for Penobscot County prosecutors and a Garland man facing drug and possession of child pornography charges.

Justice Joseph Jabar accepted the third plea agreement hammered out between the Bangor attorney representing Randy Lee Clark, 42, of Bangor and Michael Roberts, deputy district attorney for Penobscot County.

Jabar sentenced Clark to five years in prison with all but 18 months suspended and two years of probation.

He faced a maximum sentence of five years in prison. His previous convictions included two felonies – one on drug charges in 1991 in Detroit, Mich., and another on charges of passing bad checks in 2001 in Ann Arbor, Mich.

Seven months ago, Jabar rejected a plea agreement that would have had Clark serve 14 months in prison. Superior Court Justice Jeffrey Hjelm in April rejected the plea agreement Jabar accepted Friday.

Clark has been held at Penobscot County Jail, unable to make bail, since his arrest Jan. 13 in Garland. He will be credited for time served and could be released as early as April, depending on how much good time he earns in prison.

He had been staying in Garland for about 10 months with a woman and her 3-year-old granddaughter.

The woman searched through his things and found three floppy disks that had pictures of adult men having sex with children, according to court documents. Some of the girls pictured were as young as 3 years old, although most appeared to be about 8 years old.

Roberts said at the time of Clark’s arrest that there wasn’t anything to suggest Clark went beyond looking at child pornography to actually assaulting children.
