Clinic doctor loses appeal in drug fraud

BOSTON – The psychiatrist who founded a methadone clinic in Westbrook has lost his appeal of his conviction and six-month prison sentence for prescription fraud.

A three-judge panel of the 1st U.S. Circuit Court of Appeals denied the appeal of Dr. Marc Shinderman, who was found guilty in 2006 of writing prescriptions for controlled substances using another doctor’s name and drug registration number.

Shinderman, who started CAP Quality Care in 2001, was not licensed to write the prescriptions in Maine and said he believed that the arrangement was acceptable.

In its ruling Tuesday, the appeals court rejected all four of Shinderman’s arguments, including the trial judge’s refusal to allow jurors to hear his proposed entrapment defense and the use of an obstruction of justice enhancement during sentencing.
