BANGOR – The former owner of a Bangor restaurant charged with having sex with a girl under the age of 14 remains in the Penobscot County Jail unable to make bail.
Jack Dempsey Bailey II, 46, of Brewer made his first appearance Tuesday in Penobscot County Superior Court.
Bail was set at $20,000 cash or $50,000 surety.
Bailey owned Bubba Jack’s, a restaurant that was located on Odlin Road in the complex that houses Movie Magic Cinema.
He is charged with gross sexual assault, a Class A crime, due to the victim’s age, Michael Roberts, deputy district attorney for Penobscot County, said after the hearing. If convicted, Bailey faces up to 30 years in prison and a fine of $50,000.
The charge stems from Bailey’s alleged sexual contact with the victim in summer 2004. Roberts said more charges could be filed related to the alleged contact with the girl, who the prosecutor described as an “acquaintance.”
An investigation by Bangor police into a child pornography complaint led to Bailey’s recent arrest, according to the prosecutor.
Bailey’s bail conditions include no contact with the alleged victim and no possession or use of a computer.
The investigation into the child pornography complaint is continuing, Roberts said.
Bailey was arrested Friday by Brewer police at a motel where he was living, although his address listed in court papers is on Thomas Hill Road in Bangor.
He qualified for a court-appointed attorney, listing Social Security disability as his only income. He also stated he was homeless.
Bailey is scheduled to appear on May 9 for a status conference in Penobscot County Superior Court.
