AUGUSTA – A bill that would prohibit smoking in cars when children are present breezed through its first reading in the Maine Senate on Thursday with a 23-12 vote. There was no debate before the vote. Seven Republicans and 16 Democrats voted in favor of the ban.

The measure would make it a primary offense for a driver to allow smoking in any vehicle carrying children under 16. During the first year police would issue warnings; after the first year, a $50 fine could be assessed for each violation.

The bill won broad support in the House on Wednesday, with 75 Democrats, 16 Republican and one independent voting in favor. It faces additional votes in both chambers and, if enacted, will head to Gov. John Baldacci’s office for signing next week. Modeled after a Bangor ordinance and sponsored by Rep. Brian Duprey, R-Hampden, the measure would take effect Sept. 1.
