BELFAST – A Waldo County Superior Court jury deliberated for a little less than two hours Wednesday before finding Sydney Smith, 36, of Winterport guilty of three counts of unlawful sexual contact against two girls.
Smith was convicted of one count of Class B unlawful sexual contact and two counts of Class C unlawful sexual contact.
According to Assistant District Attorney Eric Walker, the Class B crime occurred in 1998 and the two Class C crimes occurred in 2002. The victims were female relatives of Smith’s and were about 11 and 12 years old at the time.
Smith faces up to a $20,000 fine and no more than 10 years in prison on the Class B charge; and up to $5,000 fine and no more than five years in prison on each of the Class C charges.
After the verdict, Justice Jeffrey Hjelm ordered Smith held without bail pending his sentencing.
Hjelm also ordered a pre-sentence investigation and forensic study to be conducted before Smith’s sentencing.
Walker was the prosecutor on the case and Belfast attorney Jeremy Marden represented Smith.
