Lewiston man faces charges in shooting

LEWISTON – A Lewiston homeowner is facing an elevated aggravated assault charge in the shooting of another man who was taking a shortcut through his yard.

Fifty-six-year-old Kenneth Phipps was in District Court on Tuesday to face the charge.

Phipps says he was acting in self-defense when he allegedly shot 44-year-old James DeHart, also of Lewiston. Police say they recovered a knife at the shooting scene, but they did not say who owns it.

DeHart says he exchanged words Monday night with a man who told him to stop cutting through his property. DeHart recalled standing several feet from the man, who pulled out a gun before DeHart was shot in the hip. DeHart was treated at a Lewiston hospital and then released.
