PORTLAND – The Maine Supreme Judicial Court has heard arguments about disputed ballots in a legislative primary race in Yarmouth and is expected to issue a written decision within a few days.

The June 10 ballot count had Melissa Walsh Innes and Kimberly McLaughlin tied with 485 votes each for the Democratic nomination in House District 107. Last week’s recount was inconclusive, showing 484 votes for Innes, 482 for McLaughlin and three ballots in dispute.

In addition, the recount showed one fewer ballot than the number counted by Yarmouth’s optical scanning machines.

The court heard arguments Monday. If it determines that the race is tied, the secretary of state will decide the winner by drawing lots.

The winner will face Republican Brian Bicknell in November.
