Man accused of rape released from jail

BROCKTON, Mass. – An 18-year-old carnival worker accused of sexually assaulting two girls he met at the Marshfield Fair has been released from jail after prosecutors dropped some of the charges.

A Superior Court judge released Jeffrey Witham on personal recognizance Friday, with the condition that the Oxford, Maine, resident stay away from the alleged victims and witnesses in the case.

Witham is accused of statutory rape of a 14-year-old girl and forcibly raping a 13-year-old girl.

On Friday, the Plymouth District Attorney’s office said there was not enough evidence to charge Witham with assaulting and forcibly raping the older girl or assaulting and kidnapping the younger girl.

The decision came after the girls changed their account of last weekend’s incident.

A probable cause hearing in the case was set for Sept. 18.
