SOUTH PORTLAND – The family of a man who was fatally shot by South Portland police has filed a lawsuit against the city’s Police Department.

The family of Donald Gray, who was shot and killed at his parents’ home in November 2006 by two officers, filed the suit in U.S. District Court in Portland.

Gray, who was 40, was shot after his parents called police after an argument. Police said that Gray ignored repeated orders to put down his pistol and they each shot four times when he pointed the weapon at one of them.

The suit claims police used excessive force and seeks unspecified damages.

An attorney general’s investigation ruled that the officers were legally justified in the shooting.
