Woman indicted in theft of $100,000 Carmel suspect worked for Community Health and Counseling Services

BANGOR – A Carmel woman was indicted Monday by the Penobscot County grand jury, accused of taking more than $100,000 over three years from Community Health and Counseling Services.

Amy McElroy, 41, is charged with Class B theft by unauthorized taking. If convicted, she faces up to 10 years in prison and a fine of up to $20,000. She also could be ordered to pay restitution.

McElroy, according to Michael Roberts, deputy district attorney for Penobscot County, was responsible for depositing checks and cash paid by clients to CHCS. Instead of depositing the checks and cash, McElroy allegedly kept the cash.

She and others indicted Monday are scheduled to be arraigned on Dec. 22 in Penobscot County Superior Court.

In another case, Benjamin Tibbetts III, 33, of Glenburn was indicted in the illegal sale of wood pellet stoves from a Bangor retail store that he managed. He is charged with Class B theft by unauthorized taking and faces the same sentence and fines McElroy does.

Tibbetts allegedly stole between $25,000 and $100,000 from Sunrise Home & Hearth Store by selling heavily discounted pellet stoves for cash and pocketing the money. The exact value of the items he allegedly stole is not yet known, Roberts said.

When he allegedly committed the theft, Tibbetts was on probation for a July 2006 conviction for burglary and theft. Tibbetts and another man were found guilty of stealing an oil truck from a Milford firm in 2005, then selling fuel to customers for as low as $1 a gallon.

He also has been charged with violating his probation and faces more than five years in prison on that charge. Tibbetts, who is being held without bail, is scheduled to be sentenced next month on the probation violation.
