Jury indicts man from Sullivan in home break-in

ELLSWORTH – A Sullivan man accused of helping to cause $60,000 in damage to a neighbor’s house is expected to be arraigned Dec. 21 on felony, burglary and aggravated criminal mischief charges, Hancock County Assistant District Attorney Patrick Larson said Wednesday.

Christopher Kidder, 18, was indicted on the charges Tuesday by a Hancock County grand jury.

Kidder was 17 in April, when he and another juvenile allegedly broke into the Toad Hole Road home of Ted and Joan Petterson and demolished the entire contents of the house. Fixtures, books, windows and furniture were demolished, allegedly by Kidder and Karl Whipple, 16, of Sullivan, when they broke into the home, a guesthouse and a truck on the property.

Last month, Kidder, who turned 18 about a week after the incident, was bound over as an adult to Hancock County Superior Court by District Court Judge Bernard Staples. Whipple pleaded guilty to identical charges in May, according to Larson.

Kidder’s attorney, Jeffrey Toothaker of Ellsworth, said after the bind-over hearing that Kidder likely would waive his right to a jury trial and plead guilty.

Twenty-three other people also were indicted Tuesday, including a man who was indicted in August on charges of stealing and forging checks from his grandmother.

Timothy S. Joy, 28, of Sullivan was indicted Tuesday on seven counts of forgery and one count of receiving stolen property.

Larson said Wednesday that the most recent charges against Joy stem from the thefts of checks from his half brother, his half sister and his neighbor. Joy allegedly acted without his twin brother, Thomas Joy, in the incidents that have led to these charges, Larson said.

“I think his brother was in jail at the time,” Larson said. Thomas Joy was involved in the check thefts from their grandmother but has pleaded guilty and already served his sentence, the assistant district attorney said.

Timothy Joy also was indicted Tuesday on charges of receiving stolen property, even though investigators believe it was Joy and his twin brother who stole about 300 lottery tickets from Dunbar’s Store in Sullivan on Sept. 21, Larson said. Joy told police he got the tickets from a friend, according to Larson. The twins allegedly stole the tickets while they were still in dispensing containers, scratched through them all and tried to redeem the winning tickets in Bangor, he said.

In August, Joy was indicted on similar charges after his brother allegedly dressed up as their grandmother and sat in the passenger seat of a car while he drove the car through the drive-in window of an Ellsworth bank, according to Larson. When the teller asked for identification, the twins are alleged to have passed their grandmother’s stolen ID and her stolen credit card to the teller through the pneumatic tube, Larson said.

Benjamin Foster, 19, of Bangor, who Larson said has a history of stealing cars, also was indicted Tuesday. Foster allegedly had stolen a 1987 Buick in Brewer when he was spotted shortly after 5 p.m. Nov. 15 driving the car south on Route 1A, according to police. Foster reportedly led seven officers from the Ellsworth Police Department, the Hancock County Sheriff’s Department and the Maine State Police on a chase north on Route 179 before the car ran out of gas in Aurora, police said. The suspect tried to run from police on foot, but was caught by Maine state troopers.

Foster was indicted Tuesday on charges of eluding an officer, failure to stop for an officer, operating a motor vehicle under the influence of intoxicants, operating a motor vehicle after suspension, violating bail and driving to endanger.

Also indicted Tuesday was a Holden man who police say broke into one business in Ellsworth and another in Dedham before breaking into a second Ellsworth business.

Larson said Shane Webber, 19, was looking for gear to use in the theft of a safe from Mike’s Country Store in Ellsworth when he allegedly broke into Willey’s Garage in Ellsworth and Blackmer’s Automotive in Dedham. Webber was caught after Ellsworth police interrupted the Oct. 31 burglary at Mike’s and caught one of two juveniles who were helping Webber, police said.

Webber was indicted Tuesday on charges of burglary, criminal trespassing, theft and criminal mischief.

Jesse A. Kovacs, 20, Ellsworth, burglary and theft.

Bert E. Sinclair, 45, Sullivan, OUI.

Frederick F. Ward, 21, Bangor, failure to stop for an officer, violation of bail and unauthorized use of property.

Wayne R. Polley, 26, Ellsworth, escape.

Shannon L. Davis, 25, Hancock, aiding escape and hindering apprehension or prosecution.

Gregory A. Spurling, 42, Surry, unlawful possession of scheduled drugs.

Gidget Middaugh, 35, Surry, unlawful possession of scheduled drugs.

Robert A. Halpin, 22, Ellsworth, trafficking in prison contraband and trafficking in tobacco in adult facility.

Joshua D. White, 22, Bar Harbor, escape.

Christopher J. Seeley, 20, Southwest Harbor, burglary and theft.
