Greenville woman seeks damages for husband

DOVER-FOXCROFT – A Greenville Junction woman has filed a two-count civil lawsuit in Piscataquis County Superior Court against a local man she thinks is responsible for her husband’s death in 1998.

Wendy Gordon, the personal representative of the estate of Roy Dean Gordon, is suing Floyd McNinch of Greenville Junction for unspecified damages.

In a court document filed this month, Gordon claims that in October 1998, her late husband and McNinch had been loading trees onto a truck at a job site in Piscataquis County when some of the logs fell off the truck, hitting and injuring Roy Gordon.

At the time of the accident, McNinch had been operating a log-loading machine and had been placing logs on the trailer as Gordon worked on the ground, the suit alleged.

The lawsuit claims Gordon’s injury and subsequent death resulted from McNinch’s negligence.

Jim Bowie, a Portland lawyer, said Tuesday he would respond to the lawsuit within the next week.

“We believe it’s an accident that occurred when Mr. Gordon came between the loader and the truck during the loading operation despite work rules against that,” the lawyer said.

Gordon is seeking compensation, as well as reimbursement of funeral expenses; damages for the loss of comfort, society and companionship of Roy Gordon, including damages for emotional distress; and damages for “conscious pain and suffering” experienced by Roy Gordon before his death.
