University of Maine women’s basketball player Heather Briggs reached an out-of-court, cash settlement just before her trial for an assault charge was to begin Thursday morning.
Briggs, the lone senior on next season’s UMaine team, and 19-year-old Sarah Fleming of Bangor, arranged an “accord and satisfaction” in which Briggs agreed to pay Fleming $150, according to Penobscot-Piscataquis County District Attorney Christopher Almy.
Fleming’s lawsuit against Briggs resulted from an incident in mid-April in which Briggs and several men showed up at Fleming’s apartment at 334 Union St. in Bangor.
According to a police report filed by Officer Paul Edwards of the Bangor Police Department, one man allegedly kicked in the door and allowed Briggs inside, whereupon Briggs allegedly assaulted Fleming and another victim.
Briggs said she was dragged into the house and had to use force to defend herself.
Judge Jeffrey Hjelm accepted the settlement at the Third District Court in Bangor Thursday morning over the objections of the District Attorney’s Office.
“We asked the court not to accept it,” said Almy. “The basic reason is it’s bad public policy for private parties to circumvent the legal process.
“We objected on public policy. It’s basically a standing policy in our office.”
Briggs and her lawyer appeared before Hjelm along with Fleming to submit their agreement for his approval.
Briggs averaged 13.2 points and 8.0 rebounds per game last season. The senior guard is from Biddeford.
