Bangor teen convicted of assault with car

BANGOR – A Penobscot County jury Thursday found a Bangor teenager guilty of deliberately running down a man with a car in the Econo Lodge parking lot last fall.

Marcus Shorey, 19, was convicted of elevated aggravated assault but found not guilty of aggravated assault. The lesser charge stemmed from a fight that took place the night of Sept. 15 outside the Odlin Road motel in Bangor shortly before Shorey struck Alan McCann, 23, of Bangor with the vehicle.

The jury of five women and seven men deliberated for about 90 minutes before delivering the verdict shortly before 7 p.m. after two days of conflicting testimony, Michael Roberts, deputy district attorney for Penobscot County, said Friday.

Roger Tenney, 21, testified for the defense Thursday that he and Shorey were picked up by two females on Center Street the night of the incident. Both men had baseball bats with them when they got into the vehicle, driven by one of the women. She was looking for her boyfriend, Andy Soucy, he said.

Tenney said that when they found Soucy, 22, of Bangor in the Econo Lodge parking lot, Soucy and his girlfriend got into a fight. He testified that he and Shorey struck Soucy with their bats after Soucy threw the first punch. The duo then got into the woman’s car.

About that time, McCann arrived, said Tenney, and blocked the exit to the street. Shorey drove around the motel as McCann chased them on foot and grabbed Tenney’s shirt through the partially open passenger window. In attempting to get away, the car struck a parked car, and McCann lost his hold on the man. After Shorey drove around the motel, McCann threw himself on the hood of the car and shattered the windshield with his elbow, said Tenney.

He testified that a few minutes later, from a nearby gas station, Shorey called 911 on his cell phone to report McCann’s injuries. Shorey and Tenney then switched places because Shorey did not have a driver’s license and headed toward the Elks Club on Odlin Road. Tenney lost control of the car when he missed the turn into the club parking lot and drove the car into a ditch. Police arrested the two hiding behind a shed a short time later.

McCann’s testimony was substantially different. He said that he had been at the pool hall and movie theater across the street and been told there was a fight going in the motel parking lot. He admitted grabbing onto the car window, but did not touch Tenney. McCann also said that Shorey deliberately ran him down, fracturing his leg and foot in several places.

Shorey remains in Penobscot County Jail awaiting sentencing. He could spend up to 20 years in prison, according to Roberts.

Tenney is being held at the jail unable to make bail for his part in the assault on Soucy. Tenney also is awaiting trial for the armed robbery of the Eastside convenience store a few days after the incident at the Econo Lodge.
